These terms of use (the "Terms") govern your use of avunu.net (the "Site"). The Site is owned and operated by Avunu LLC ("Avunu", "we", "us"). It is an informational website about our services, with a public knowledge base and a catalog of our open-source projects.

By using the Site, you confirm that you have read and understood these Terms and agree to follow them.

Our services

The Site describes our services, but you can't buy anything on it. Consulting, implementation, development, hosting, and other services are provided under a separate written agreement, such as a proposal or statement of work, that sets out the scope, pricing, and payment terms. If that agreement conflicts with these Terms, the agreement wins.

We try to keep descriptions of our services accurate and current, but they are general information, not an offer or a guarantee of specific results.

Intellectual property

Unless stated otherwise, the content on the Site, including text, images, logos, and design, belongs to Avunu LLC and its creators. The Avunu name and logo are our trademarks. You may not use them in a way that suggests we endorse you or your products without our written permission.

Knowledge base articles, including the code samples in them, are dedicated to the public domain under CC0 1.0. Copy, adapt, and reuse them for any purpose, without asking. A link back is appreciated but not required.

Open-source projects

Our open-source software is published under the license included in each project's repository. Those licenses, not these Terms, govern your use of the software. The Site's catalog of projects is provided for information.

Knowledge base disclaimer

The knowledge base shares technical notes from our own work. It is provided "as is", without warranty of any kind. Software, versions, and environments change, and a command that is safe on one system can cause problems on another. Always test changes outside production, keep current backups, and use your own judgment. You are responsible for how you apply anything you read on the Site.

Age requirement

The Site is intended for people 13 years of age and older. By using the Site, you confirm that you are at least 13. We don't accept legal responsibility for false statements about age.

Acceptable use

You agree to use the Site lawfully and not to:

• Use the Site for any illegal or fraudulent purpose;

• Violate the rights of others, including their intellectual property rights;

• Attempt to gain unauthorized access to the Site, our systems, or anyone else's account;

• Interfere with the Site's operation, including by overloading it, scraping it in a way that degrades it, or bypassing its spam protection; or

• Submit content through our forms that is abusive, offensive, or misleading, or that contains malware.

If we believe you are using the Site unlawfully or in violation of these Terms, we may limit or block your access and take any legal steps we consider necessary.

Client portal

Existing clients can sign in to our client portal at erp.avunu.net. If you have a portal account, you are responsible for keeping your login details secure and for activity under your account, and you agree to keep your contact information accurate. Use of the portal is also governed by your service agreement with us. We may suspend portal access that is used unlawfully or in violation of these Terms.

Third-party links and services

The Site links to websites and services we don't own or control, such as GitHub, LinkedIn, and the projects we build on. We aren't responsible for their content, policies, or practices. Please read their terms and privacy policies before using them.

Consumer protection law

Where consumer protection laws in your jurisdiction apply and cannot be excluded, these Terms do not limit your rights and remedies under those laws. These Terms will be read subject to the mandatory provisions of those laws, and if there is a conflict, the mandatory provisions apply.

Limitation of liability

To the fullest extent permitted by law, Avunu LLC and its directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses, including legal fees, arising from your use of the Site or its content.

Indemnity

Except where prohibited by law, by using the Site you agree to indemnify and hold harmless Avunu LLC and its directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities, and expenses, including legal fees, arising from your use of the Site or your violation of these Terms.

Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania.

Dispute resolution

Subject to any exceptions in these Terms, if you and Avunu LLC can't resolve a dispute through informal discussion, you both agree to submit it first to a non-binding mediator and then, if mediation fails, to an arbitrator. The arbitrator's decision will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and Avunu LLC. The unsuccessful party will pay the costs of mediation or arbitration.

Notwithstanding anything else in these Terms, you and Avunu LLC each keep the right to bring an action in small claims court and to seek injunctive relief or bring an action for intellectual property infringement.

Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be removed and the rest of these Terms will remain in effect.

Changes to these terms

We may update these Terms to stay compliant with the law or to reflect changes in how we operate the Site. When we do, we'll update the effective date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.
